These Terms of Service ("Terms") govern your access to and use of the Level Up mobile application and website (the "Service"), operated by Level Up ("we", "us"). By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
You must be at least 13 years old (or the minimum age of digital consent in your country) to use the Service. By using it, you represent that you meet this requirement and that the information you provide is accurate.
Level Up provides general fitness and wellness content for informational and motivational purposes only. It is not medical advice. Consult a physician before beginning any exercise program, especially if you have a medical condition or injury. You exercise at your own risk, and you are solely responsible for performing movements safely. We are not liable for any injury, harm, or loss resulting from your use of the workouts or content.
You are responsible for activity under your account and for keeping your sign-in method secure. You may delete your account at any time from Settings → Account in the app. We may suspend or terminate accounts that violate these Terms or misuse the Service.
We grant you a personal, non-exclusive, non-transferable, revocable license to use the Service for your own non-commercial use, subject to these Terms. You may not copy, resell, reverse-engineer, or redistribute any part of the Service.
All content in the Service — including the character Kai, all artwork, manga panels, story text, names, logos, and software — is original intellectual property owned by us or our licensors and is protected by law. You receive no ownership rights. You may share rank-up cards and screenshots the app generates for personal, non-commercial promotion of the Service.
You agree not to: misuse or disrupt the Service; attempt to access other users' data; use automated means to access the Service; or use it for any unlawful purpose.
If you submit feedback or suggestions, you grant us a perpetual, royalty-free license to use them to improve the Service, without obligation to you.
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy of results, or uninterrupted availability. We do not guarantee any specific fitness outcome; individual results vary.
To the maximum extent permitted by law, Level Up and its officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.
We may modify or discontinue features, and may update these Terms from time to time. Material changes take effect when posted (with an updated date above). Continued use after changes constitutes acceptance.
These Terms are governed by the laws of France, without regard to conflict-of-laws principles. Disputes will be resolved in the courts of that jurisdiction, unless mandatory local law provides otherwise.
This app is made available via the Apple App Store. You acknowledge that these Terms are between you and us, not Apple, and that Apple is not responsible for the app or its content. Apple is a third-party beneficiary of these Terms and may enforce them. Standard Apple Licensed Application End User License Agreement (EULA) terms also apply.
